Terms of Use
Acceptance
These Terms of Use ("Terms") govern your access to and use of the BlurPOV application and any related services (together, the "App"). By installing, launching, or using the App, you agree to these Terms. If you do not agree, do not use the App.
License
Subject to these Terms, BlurPOV grants you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal or internal business purposes.
You may not, and may not permit anyone else to:
- copy, modify, reverse-engineer, decompile, or disassemble the App, except where this restriction is prohibited by law;
- rent, lease, sublicense, sell, or otherwise transfer the App or your rights under these Terms;
- remove or alter any proprietary notices, trademarks, or labels on the App;
- use the App to develop a competing product.
Acceptable use
BlurPOV is a redaction tool. You are responsible for the videos you import and the videos you produce. You agree not to use the App:
- to record, process, or distribute video of people in violation of applicable privacy, wiretap, or recording-consent laws;
- to harass, stalk, threaten, defame, or impersonate any person;
- to circumvent any lawful obligation to preserve evidence or to retain unredacted material;
- to process content you do not have the right to process;
- in connection with any unlawful activity, including the creation of non-consensual intimate imagery or content sexualizing minors.
The App's redaction features are designed to obscure faces but no automated tool is perfect. You are responsible for reviewing output before sharing it.
Your content
You retain all rights in the videos and other content you process with BlurPOV. Because the App processes content on your device, BlurPOV does not receive a copy of your content and does not claim any license to it. You are solely responsible for backing up content you care about.
Intellectual property
The App, including its source code, design, branding, and any documentation, is owned by BlurPOV and its licensors and is protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you.
Apple App Store terms
If you obtained the App through Apple's App Store, you acknowledge that these Terms are between you and BlurPOV, not Apple. Apple is not responsible for the App or its contents and has no obligation to provide support. To the extent these Terms conflict with the Apple Media Services Terms, the Apple Media Services Terms control with respect to your use of the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.
Updates and availability
BlurPOV may release updates that add, change, or remove features. We do not guarantee that any specific feature, capability, or compatibility will remain available, and we may discontinue the App at our discretion. Updates may be required to keep the App functional.
Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL FACES IN A GIVEN VIDEO WILL BE DETECTED OR REDACTED. YOU USE THE APP AT YOUR OWN RISK.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLURPOV AND ITS LICENSORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR FIVE U.S. DOLLARS, WHICHEVER IS GREATER.
Indemnification
You agree to indemnify and hold harmless BlurPOV and its affiliates from any claims, damages, or expenses arising out of (a) your use of the App, (b) your content, or (c) your violation of these Terms or applicable law.
Termination
These Terms remain in effect while you use the App. You may terminate by deleting the App from your devices. We may terminate or suspend your license at any time if you violate these Terms. Sections that by their nature should survive termination will survive.
Governing law
These Terms are governed by the laws of the jurisdiction in which BlurPOV is established, without regard to conflict-of-laws principles. Any dispute that cannot be resolved informally will be brought in the courts of that jurisdiction, except where applicable consumer protection law grants you the right to your home jurisdiction.
Changes to these Terms
We may revise these Terms from time to time. The updated Terms will be posted here with a new effective date. If a change materially reduces your rights, we will surface it in the App before it takes effect. Continuing to use the App after a change means you accept the updated Terms.
